Arizona HOAs: What New Buyers Should Know

If you’re buying anything built in the Valley in the last 30-plus years, there’s a good chance it comes with a homeowners association. Some are great. Some will send you a letter about your trash can.

Updated October 2026. Rules and fees change; confirm with the official source linked in each section.

What HOAs typically cover

  • Common-area landscaping, parks, pools, greenbelts and trails
  • Amenities like clubhouses, lakes and gyms
  • Architectural standards (paint colors, landscaping, additions)
  • In condos and townhomes: often exterior, roof, structure insurance, and sometimes water/trash

Fees to expect

  • Monthly or quarterly dues
  • Transfer and disclosure fees at closing
  • Capital improvement / reserve contribution at closing in many communities
  • Special assessments if reserves fall short
  • A master association plus a sub-association can mean two sets of dues

Documents to read during your inspection period

  • CC&Rs (the rules)
  • Bylaws and rules & regulations
  • Budget and reserve study: are reserves adequately funded?
  • Recent board minutes (look for lawsuits, special assessments, big projects)
  • Rental restrictions, if you might rent it out later
  • RV/boat parking, solar, pets and short-term rental rules

Your rights

Arizona’s planned-community and condominium statutes govern HOAs, including open meetings, records access, and limits on certain restrictions (for example, HOAs generally can’t prohibit solar panels or flying the American flag). The Arizona Department of Real Estate runs a dispute process for some HOA conflicts.

No-HOA options

Want to park the RV and paint the door purple? Look at older Phoenix neighborhoods, county-island properties, and acreage in Queen Creek, North Phoenix, Cave Creek or the far West Valley. Ask your agent to filter for “no HOA.”
